This Deed made the twenty-fourth day of October 1850, between William Outten and Margaret W. his wife of the one part, and Thomas N. Mercer of the other part witnesseth, that for and in consideration of the love and affection which the said William Outten and Margaret W. his wife have for the said Thomas N. Mercer, and for the further consideration of the sum of five dollars to them in hand paid, they the said William Outten and Margaret W. his wife do grant unto the said Thomas N. Mercer all that certain lot of land situate in the town of Portsmouth on Dinwiddie Street, it being the same lot of which which was conveyed to the said William Outten by John S. White and wife by deed of record in the Clerk's office of Norfolk County Court and the said William Outten and Margaret W. his wife hereby release to the said Thomas N. Mercer all their claims in the said lot of land witness the following signatures and seals.

4. Deed 3036, between Robert Dickson, Joseph Bourke, Thomas Brooks, Winchester Watts & Thomas N. Mercer, 13 May1851 in Norfolk Co., Virginia
Whereas Robert Dickson and Joseph Bourke severally and Thomas Brooks Jr., Winchester Watts and Thomas N. Mercer joinity are seized in fee simple respecfully of three adjacent lots of land of about equal size and value which together constitute a lot of land bounded as follows, to wit: commencing on the north side of High Street in the Town of Portsmouth at the line of Robert M. Boykin thence running along said line north fifty six feet six inches, thence west about sixty nine feet to the line of the estate of William Portlock dec'd thence along said line south fifty six feet six inches to High Street and thence along High Street east about sixty nine feet to the beginning; and the said Dickson, Bourke, Brooks, Watts and Mercer have agreed to erect a building on said land comprising five stores with cellars and above the stores an assembly room or hall, the said building to be erected and completed according to the agreements and specifications entered into between the said parties and Willoughby G. Bulter and others or to such as they may hereafter adopt by unanimous concurrence, and to bear and defray the expenses of erecting and completing said building including the costs of half the party wall on the line between the said land and that of R. M. Boykin, respectively in the proprtions to which they are entitled to the said land to wit, the said Dickson and Bourke each three nineths thereof and the said Brooks, Watts and Mercer each one ninth thereof and have agreed that the said land and buildings should during the existence of said building be held by them jointly for their joint use in the store named proportions, subject to the covenants hereinafter contained and set forth: Now this Deed made this 13th day of May in the year 1851 by the said Robert Dickson, Joseph Bourke and Virginia A., his wife, Thomas Brooks Jr, and Julia, his wife, Winchester Watts and Thomas N. Mercer and Mary Jane, his wife, witnesseth that for and in consideration of the premises and of the covenants hereinafter contained and of the sum of five dollars paid to each of said parties, the others the receipt whereof is hereby acknowledged the said Robert Dickson doth grant unto the said Joseph Bourke his heirs and assigns an undivded third and to the said Thomas Brooks for his heirs and assigns, Winchester Watts his heirs and assigns and Thomas N. Mercer his heris and assigns each an individed ninth part of that portion of the land aforesaid of which he the said Dickson is seized in fee simple was aforesaid, during the existance of the building to be erected as aforesaid; and that the said Joseph Bourke and Virginia A. his wife do grant unto the said Robert Dickson his heirs and assigns an undivided third and to the said Thomas Brooks Jr. his heirs and assigns, Winchester Watts his heirs and assigns and Thomas N. Mercer his heirs and assigns each an undivided ninth part of that portion of the land aforesaid of which he the said Bourk is seized in fee simple as aforesaid during the existance of the building to be erected as aforesaid; and that the said Thomas Brooks Jr. and Julia his wife, Winchester Watts and Thomas N. Mercer and Mary Jane his wife do grant unto the said Robert Dickson his heirs and assigns and Joseph Bourke his heirs and assigns each an undivided third part of that portion of the land aforesaid of which they the said Brooks, Watts, and Mercer are seized in fee simple as aforesaid during the existance of the building aforesaid. To have and to hold the same respectively unto the said several grantees during the existance of the said building and subject to the covenants hereinafter set forth and contained to which also the said several grantees hereby subject the undivided portions of the said several parts of said land reended by each respectively. And the said Robert Dickson, Joseph Bourke, Thomas Brooks Jr., Winchester Watts and Thomas N. Mercer each covenant with each other and all the others as follows, That he, the covenantor his heirs executors administrators and assigns will bear and defray this due proportions as alone stated of all the expenses and charges incurred in the erection and completion of the building to be erected as aforesaid including the costs of half the party wall aforesaid, that the said land and the buildings erected thereon as aforesaid and the rents issues and profits thereof until the said building is destroyed by violence, casualty, natural decay or otherwise shall be held and enjoyed by the said covenantors their heirs and assigns as joint tenants for their own use in the all named proportions to with the said Dickson three ninths, Bourke three ninths and Brooks, Watts and Mercer each one ninth, subject to the covenants herein set forth, without set hindrance or in temption of the covenantor his heirs or assigns; that in the event of the destruction of said building as aforesaid each covenantor his heirs and assigns shall be reunited to his original estate in the respective portions of said land in fee simple as above stated and the various grants herein contained be thenceforth void and of no effect, and in that event, that the remains of said building including half the party wall aforesaid shall be valued by arbutrators, one appointed by each interest of three ninths with authority to any two to decide, and the covenantor his heirs or assigns on whose portions of said land such remains shall be, shall pay for and take them at the value awarded, the said amounts so paid to be distributied among the said covenators their heirs and assigns in the proportion of their respective interests in said land and building as above set forth but it is agreed that this provision shall not embrace the remains of so much of the western wall of said building as was erected and purchased by said Dickson along with his portion of said land in the year 1850, and that on the destruction of the said building as aforesaid the remains of said portions of said wall as far as they can be contained shall revert to the said Dickson his heirs and assigns. That the covenant his heirs and assigns shall and will not sell or convey his interest in the said land or building without first giving the covenantees their heirs and assigns their election to take said interest at the sum bona fida offerred for it, and every contract made for the sale of such interest shall be subject to this covenant. That for each and every interest of one ninth in said land and building the owner thereof shall have a role in the control and management therof and in any and every matter relating to the erection, control or management of the said building or pertaining to the joint property; and any matter whatever relating to said land or building not specially provided for in this deed shall require a vote of two thirds for its adoption that is six votes, and where so adopted shall be binding upon each covenantor his heirs and assigns provided, that no improvement or addition to the building aforesaid after its completion costing more that two hundred dollars shall be made save by a unanimous vote. That if those representing and interest of seven ninths in said land and building or seven votes at any time desire to make an improvement or addition to the said building costing over two hundred dollars, and these representing the whole or any portion of the remaining interest of two ninths oppose it, these representing the said interest of seven ninths and desiring the improvement or addition shall have their election to purchase the interest in said land and building of those opposing the improvement or addition at a price to be fixed by arbitration, these desiring the improvement or addition selecting one arbitrator and those oppose to it another with power to the arbitrators to choose an umpire whose decisions or award when made shall be binding on all the parties. That the representative or representatives of an interest of three ninths in siad land and building shall have authority at any and all times to call a meeting of the joint owners of said property who may appear at said meeting either inperson or by proxy; and one day's notice of the time and place of said meeting being served either orally or in writing on all the joint owners, the representatives of seven ninths of said property shall form a quorum competent to transact all business relating to said property not requiring under the provisions of this deed a larger vote than they represent . And it is expressly understood and agreed by and between all the covenantors for themselves their heirs and assigns that as covenantor his heirs executors, administrators or assigns is in any way to be held liable or accountable under the foregoing covenants, save as far as he his heirs executors administrators or assigns shall fail to do keep and perform the same and that neither he nor they are in any way to be charged or held responisible for the failure or default in or non performance of said covenants or any of them of any other covenantee his heirs executors administrators or assigns . Whereas George R. Snead and Sarah his wife in order to secure to William Outten (now deceased) the payment of a note of eleven hundred dollars did by deed bearing date the 21st day of December 1858 and duly recorded convey unto Thomas N. Mercer as trustee the following described lot piece or parcel of land with its appurtenances situate lying and being in the City of Portsmouth, bounded as follows to wit: Beginning sixty feet from the south east intersection of Chestnut and Bart Streets, running East along Bart Street thirty feet, thence sount one hundred and thirteen feet, thence west thirty feet thence north one hundred and thirteen feet to the beginning, and whereas the said George R. Snead had failed to pay the said debt of eleven hundred dollars and the interest thereon from the 21st day of December 1861 and the personal representatives of the said William Outten having required the trustee to make sale of the property conveyed as aforesaid for the purpose of paying the said debt and interest and the said George R. Snead consenting to said sale as will appear by his note in writing appended to this deed and hereby made a part thereof the said Thomas N. Mercer the trustee after having duly advertised the time and place of sale did copose to sale before the Court House door in the City of Portsmouth on Tuesday the 7th day of November 1865 by public auction the herein before mentioned and described lot piece or parcel of land with its appurtenances at which sale William Schroeder being the highest bidder became the purchaser thereof at the price of five hundred dollars, which sale being upon a credit of thirty days and the said William Schroeder having this day paid the purchase money in full to the said Thomas N. Mercer the trustee is hereby entitled to a deed from the same.
Now this deed made this 7th day of December in the year of our Lord one thousand eight hundred and sixty five between the said Thomas N. Mercer trustee as aforesaid of the one part and the said William Schroeder of the other part. Witnesseth--that the said Thomas N. Mercer, trustee as aforesaid in consideration of the premises aforesaid and of the further consideration of the sum of five hundred dollars; the consideration money aforesaid to him in hand paid by the said William Scroeder the receipt thereof is hereby acknowledged, doth grant with special warrantry unto the said William Schroeder the hereinbefore mentioned and described lot piece or parcel of land with its appurtenances.

This Deed made the 23rd day of November A. D. 1870 between Thomas N. Mercer and Mary Jane his wife of the first and Edward Alexander Hatton of the second part . Witnesseth that in consideration of the sum of five dollars in hand paid at and before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged the said Thomas N. Mercer and Mary Jane his wife, with general warranty unto the said Edward Alexander Hatton all of the following property, viz: all of that certain tract piece or parcel of land situated in the parish of Portsmouth in the county of Norfolk--except ten acres and 43/100 acres of the said land sold by said Mercer to R. T. Shea, which was conveyed to the said Thomas N. Mercer by Wm. Benthall & Jane A. his wife by deed of record in the clerk's office of Norfolk County Court, and bounded as in said last mentioned deed described to which last mentioned Deed reerence is hereby made for a more particular description of the same. In Trust to secure to Mary Ann Hatton the payment of a debt of twenty five hundred dollars evidenced by two bonds of said Thomas N. Mercer of even date herewith, executed by him and payable to the said Mary Ann Hatton as follows: The first of said bonds in the sum on one thousand dollars payable two years after date, with interest thereon from date at the rate of twelve per centum per annum payable semi annually from date and the second of said bond in the sum of fifteen hundred dollars, payable three years after date with interest thereon from date at the like rate of twelve per centum per annum payable semi annually from date and to secure the payment of said interest as the same shall fall due and payable and in the event of a sale the said Thomas N. Mercer & Mary Jane is wife covenant that the commissioner of the Trustee shall be five per cent upon the amount for which the said land shall be sold.

29. Deed 3052, T. N. Mercer to George W. Grice, 9 Oct 1871 in Portsmouth, Norfolk Co., Virginia
This Deed made this 9th day of October in the year 1871, between Thomas N. Mercer & Mary Jane his wife, of the one part and George W. Grice of the other part: Witnesseth that the said Thomas N. Mercer and Mary Jane his wife doth grant unto the said George W. Grice all that lot piece and parcel of land, with the improvements thereon situate and being on the east side of Dinwiddie Street between County and King Sts in the city of Portsmouth which was deeded to the said Thomas N. Mercer by William Outten and wife by their deed of record in the Clerk's Office of Norfolk County Court dated the 24th day of October 1850, the said William Outten having purchased the same from John S. White and wife as per their deed also of record in the Clerk's Office of Norfolk County Court and dated 22nd day of September 1849. In trust to secure the payment of a certain negotiable note signed by the said ? as N. Mercer for the sum of one thousand dollars payable twelve months after date at the Bank of Portsmouth with interest at the rate of twelve per centum per annum payable semi-annually, payable to M. D. Eastwood and dated this 9th October 1871 and for any and all notes which may be give in renewal or continuation of the same, and it is understood and agreed that the said Thomas N. Mercer shall insure in some good and reliable Insurance Company the dwelling house on said lot piece and parcel of land for a sum of eight to twelve hundred dollars, in the name of the said George W. Grice, trustee for the benefit of this trust and keep the same so insured during its continuance and doth convence that in the event of his failure to so insure, the trustee so do so and charge the premium as so much additional money on account of this trust. It is further understood and agreed that in the event of a sale under this trust the trustee shall receive five per centum commissions.

Mercer whose names are signed to the writing annexed bearing date on the 9th day of October 1871, personally appeared before me in the corporation aforesaid and being examined by privily and apart from her husband and having the writing aforesaid fully explained to her, she the said Mary Jane Mercer acknowledged the said writing to be her act, and declared that she had willingly executed the same and does not wish to retract it. This Deed made this first day of August A. D. 1872, between Elizabeth Keenan and Thomas N. Mercer and Mary Jane, his wife, of the county of Norfolk and State of Virginia, parties of the one part, and Joseph A. Parker, trustee, of the City of Portsmouth and State of Virginia, party of the other part: Witnesseth that the said Elizabeth Keenan and Thomas N. Mercer and Mary Jane, his wife, for and in consideration of the sum of five dollars cash in hand paid, the receipt of which they do hereby acknowledge, do grant with general warranty unto the said Joseph A. Parker, trustee, the following property to wit, all that certain lot, piece or parcel of land, with its appurtenances, situate in the City of Portsmouth, and bounded as follows, niz: Beginning at the intersection of King and Dinwiddie Streets and running south on west side of Dinwiddie Street one hundred and thirteen (113) feet, thence west one hundred and eighty (180) feet, thence north one hundred and thirteen (113) feet to King Street, thence east on south side of King Street one hundred and eighty feet (180) to the beginning and known in the plan of the town of Portsmouth as lot no. 128, in Princess Square, and is the same lot of land which was conveyed to the said Elizabeth Keenan and Jane Keenan and Elenor Keenan, by deed of Gift from their uncle James Keenan, and wife, dated 22nd August 1815 and of record in the Clerk's Office of Norfolk County Court. Jane Keenan and Eleanor Keenan being now dead; and the said Mary Jane, wife of the said Thomas N. Mercer, being the only heir at law of the said Eleanor Keenan, Jane Keenan having died without issue, never having married. In trust, however to secure to W. G. W. Parker the payment of bond executed by the said Elizabeth Keenan of even date with this deed, payable one year after date thereof, for the sum of two hundred and fifty dollars, with interest thereon to be computed after the rate of 12 per centum per annum from date of said bond until paid. And the said Elizabeth Keenan, Thomas N. Mercer and Mary Jane, his wife, hereby waive all benefit under the act known as the "Homestead Exemption Act" as to the debt, obligation, or contract secured by this deed. Murdaugh one of the commissioners of this Court to ascertain and report to Court the real estate of which the defendant is seized and possessed the fee simple and annual value thereof--and all the liens thereon created by Deeds of Trusts, Judgements, or otherwise--their nature, amounts and priorities--together with such other matters deemed pertinent by him or which may be required by the parties to this suit.
