This cause this day came on to be heard by consent as well of the plantiff as the defts by their guardian upon the bill & answer this day filed. On consideration whereof it is decreed & ordered that Wright Bowers, George King and Robert Cox Gent or any two of them make sale for ready money after giving due notice, of the two sixths of of ninety three and three quarters acres of land in the bill mentioned to wit thirty one acres and divide the money arising therefrom in the following manner: to the plantiffs in right of the said Ann Bacon one ninth part thereof in lieu of her right of dower in said land, and the residue to divide equally between the defendants Judy, Elizabeth & Martha Bacon and make report thereof in order to a final decree.

Humbly complaining show (missing piece of document) __ator Robert Manning and Ann his wife late Anne Bacon widow of Stephen Bacon. That Stephen Bacon late of said County was in his lifetime and at the time of his death entitled to two sixths of an undivided tract of land in said County late the property of Richard Bacon containing by a late survey ninety three and three quarters acres, subject to the dower of his widow Joyce Bacon therein. That the said Stephen Bacon being so entitled departed this life intestate on the ___ day of ___ leaving Judy, Elizabeth and Martha Bacon his children & heirs at law to whom the said two sixths of 93 3/4 acres of land descended subject to the dower of your oratrix in the same.
Your orator & oratrix also beg leave to observe that by law provided that whenever any lands shall descend to two or more heirs; any one of whom shall be an infant, & in Court, noncompormusly or beyond sea, and the dividend of each heir in said land shall not exceed in value the sum of $100 in the opinion of the Court, that heir or shall & may be lawful for the Court to direct a sale of the said lands and a distribution of the proceeds according to the rigfhts of each claimant. Your orator & oratrix are will assured that the dividend of each claimant in the aforesaid land will not be worth $100 and as your oratories a firm court and the other heirs infants of tender years they humbly conceive that a sale of the said land be made and the money arriving therefrom divided (missing piece of document) ---atrix and the said Judy, Elizabeth & Mar___ (missing piece of document) respective intent therein
In tender consideration whereof and for as much as can of this bind an property cognizable in this worshipful court to the end therefore that a sale and division of the above mentioned land may be effected, your orator & oratriz pray that the said infants may be made parties & defendants hereto & that they may by their guardian answer the allegations aforesaid & say if they are not true. That commissioners may be appointed to make date & division of the said land in manner aforesaid. And that your orator & oratrix may have all such other & further relief in the premises as to your worship shall appear to be just and equitable. May it please your worship to grant to your orator & oratirix the Commonwealths writ of subpoena etc.

The Answer of Judy, Elizabeth of Stephen Bacon and by Robert Manning answer of his wife Ann guardian to the bill of complaint of exhibited against them in this worshipful by the said Manning & wife.
The defts: now and at all times hereafter saving & reasoning to themselves all benefit & advantage of exception to the complamants bill for answer thereto, they by their said guardian do say. That they admit the allegations of said bill to be true as far as they know or believe and that they have no objection to offer why a sale of the land mentioned in said bill should not be made and the money arising therefrom divided according to the prayer of the bill.

In the suit between Bacon or Bacon Rep't ent'd at Sept 1806 it will be discovered that Stephen Bacons children to wit: Judy, Elizabeth & Martha Bacon had assigned to them 37 1/7 acres of land being two fifths of the whole land, when they were only entitled to two sixths, to wit 31 acres. The present suit is brought for the sail of this 31 acres and as James Bacon who is entitled to the excess of 6 1/2 acres is willing to sell the same at the same time that the purchaser gives for the 31 acres under this order, the purchaser will buy 37 1/2 acres & James Bacon must join the commissioners in the deed.

Samuel D. T. Manning, aged 80 years, died at 11: 35 o'clock yesterday morning in his residence, 643 Armstrong Street.
He is survived by two daughters, Miss Agnes A. Manning, of Tulsa, Okla., and Miss Jennie A. Manning, of this city; sons, John and William R. Manning, of this city, and Walter Manning of Ocean View, and six grandchildren.
Mr. Manning held membership in the First Congregational Church, the Woodsmen of the World and the Odd Fellows.
Funeral service will be conducted in the Congregational Church at 4 o'clock tomorrow afternoon. Burial will take

Funeral service will be conducted at 4 o'clock Wednesday afternoon in the First Congregational Church. Friends and acquaintances are invited to attend. Interment in Oak Grove Cemetery.

Samuel D. T. Manning, who died Monday morning, was buried this afternoon in Oak Grove Cemetery. Funeral services were conducted at 4 o'clock in the First Congregational Church, the Rev. C. E. Shelton, pastor officiating.
There were many floral tributes including a casket spray of roses and lillies. Active pallbearers were John Flemming, Arthur Pope, E. C. D. DeVille, E. Winn and W. T. Cherry, the last two representing the I. O. O. F.; C. R. Smith and W. T. Robinson, representing the W. O. W.; J. H. Sykes and M. Padden; representing the First Congregational Church.

I, Samuel D. T. Manning, being a sound and disposing mind, do make, publish and declare this to be my last will and testament, hereby revoking all wils and codicils by me at any time heretofore made.
First: I direct that all my just debts and funeral expenses be paid by my Executrix as soon after my decease as practical.
