This cause came on this day to be heard upon the papers formerly read, upon the report of Commissioners Brinkley, this day filed, to which no exceptions have been taken, the ten days required by law for the filing of the said report in the Clerk's Office, having been waived by all parties, by counsel, and was argued by counsel; On consideration whereof the Court doth confirm said report. And it appearing from said report that partition of the real estate in the bill mentioned cannot be had, that the plaintiffs, Fred W. Beazley and Paul G. Blanford, own an undivided twenty-nine thirty-sixths of said property and are willing to have the entire property allotted to them, and to pay to the other parties in interest such sums of money as their interest therein may entitle them to receive; that all the necessary and proper parties are properly before the Court; that the entire property is of the value of fifty-two hundred and fifty ($5250.00) dollars, that it has no annual value, and that the interests of the others defendants, who are all of the other parties interested therein, is an undivided seven thirty-sixths thereof, and that they are entitled to receive the sum of one thousand and twenty and eighty-one hundredths ($1020.81) dollars on account of their said interests; and the plaintiffs having paid into this Court, to be deposited to the credit of the court in this cause, the sum of one thousand and twenty and eighty-one hundredths ($1020.81) dollars, the Court doth adjudge, order and decree that the property in the bill mentioned and described, and which is bounded and described as follows: That certain lot of land, with the improvements thereon situated on the south side of High Street, in the City of Portsmouth, Virginia, beginning two hundred and forty (240) feet eastwardly from the Southeastern intersection of Fourth Avenue, formerly Grace Street, with High Street, thence East along High Street thirty (30) feet; thence South and parallel with Fourth Avenue, one hundred and eleven (111) feet, six (6) inches; thence West and parallel with High Street thirty (30) feet; and thence North and parallel with Fourth Avenue, one hundred and eleven (111) feet, six (6) inches, to the beginning, be, and the same is hereby allotted to the plaintiffs, Fred W. Beazley and Paul G. Blanford, infee; and the Court further adjudge, order and decree that said sum of one thousand, twenty and eight-one hundredths ($1020.81) dollars be forthwith deposited by the Clerk of this Court in the Bank of Tidewater, Incorporated, of the City of Portsmouth, to the credit of the Court in this cause, to be paid over to the parties interested therein, according to their respective interests, and as may hereafter be directed.
And the Court doth further adjudge, order and decree that the Clerk of this court shall immediately transmit to the Clerk of the Court of Hustings for the City of Portsmouth, Virginia, a copy of this decree, and said Clerk is hereby directed to record and index the same according to Section 5216 of the Code of Virginia.

It is ordered that Court do adjorn to Court in Course.

This day came the plaintiffs Fred W. Beazley and Paul G. Blanford and by leave of the court filed their bill in this cause, and on their motion the court doth appoint Norman Cassell, a discreet and competent attorney practicing in this court, to defend the infant defendants, and thereupon by like leave the said Norman Cassell filed his answer as guardian ad litem to the infant defendants, Mortimer G. Cassell, Jr., Harriett H. Cassell, Theus Powe Cassell, Mary C. Johns, Virginia Gavett Johns, Mary Adelia Johns, Charles W. Johns, Jr., Pauline Grace Johns, Frances Lee Johns, James Healy Johns and Janice Mae Johns, and the answer of said infant defendants by him as their guardian ad litem, and by like leave of court Virginius M. Johns, Charles White Johns, and James R. Johns filed their joint and separate answer to said bill, and thereupon on motion of the plaintiffs this cause is placed upon the docket and set for trial. And thereupon this cause came on this day to be heard upon the bill of the plaintiffs and the exhibits therewith, upon the joint and separate answer of Virginius M. Johns, Charles White Johns, and James R. Johns this day filed, upon the answer of Norman Cassell guardian ad litem for all of the infant defendants and upon the answer of all of the infant defendants by said Norman Cassell their guardian ad litem upon general replications to said answers and was argued by counsel. On consideration whereof the court doth adjudge, order and decree that their cause be referred to one of the Commissioners in Chancery of this Court who is directed to examine into and make report to this court.
1. Whether the real estate in the bill mentioned is susreptible of partition in kind, and if not;
2. Whether any of the parties interested will take the entire property and pay to the others such sums of money as their interest therein will entitle them to receive; and if not,
3. Whether the interest of all parties interested therein will be promoted by a sale of the entire property and a sale of the entire property and a division of the proceeds amoung the parties entitled thereto.
4. Whether the necessary parties are before the court in this cause
5. The annual and fee simple value of the property
6. What if any liens, including taxes, there may be upon said land
7. Any other matter which he may deem pertinant or which he may be requested by any party to report.

Ordered that Court be adjourned till April 9th 1920, at 11 o'clock a.m.

Norman Cassell, 89, Former Lawyer of Portsmouth, Dies
Norman Cassell, 89, former Portsmouth lawyer, died at the residence of his daughter, Mrs. Charles Sharp Willcox, 619 Graydon Avenue, yesterday at 6 p.m., after a long illness. A vative and lifelong resident of Portsmouth, he was the son of the late Virginius O. and Mrs. Jane Tatem Cassell.
Besides Mrs. Willcox, he is survived by one son, W. H. W. Cassell, of Portsmouth; two grandsons, Charles Sharp Willcox, Jr., and Norman Cassell Willcox; one granddaughter, Virginia Stevens Willcox; a great-grandson, Charles Sharp Willcox III, all of Norfolk, and one sister, Mrs. Robert L. Martin, of Portsmouth.
The body was taken to the H. D. Oliver Funeral Apartments pending arrangements.

Norman Cassell, a prominent attorney of Portsmouth, Norfolk County, Virginia, whose office is located in the Merchants & Farmers Bank building, has been practicing law in Portsmouth since 1882. He was born in that city, and is a son of Virginius O. Cassell.
Charles Cassell, the grandfather of Norman, located in Norfolk County, in 1826, coming from Washington, D.C. His son, Virginius O. Cassell, was born in the town of Portsmouth, Norfolk County. His death occurred there in 1891 at the age of 64 years. He was a lawyer, and at one time served as Commonwealth's attorney of Norfolk County. During the Confederate War, he was captain of a Virginia company and rendered valuable service in the Confederate cause. He married Jane Manning, who was born in Norfolk county, and is now residing in Portsmouth. They reared several children, who are engaged in various lines of business.
Norman Cassell attended the University of Virginia, took the degree of B. L. in June, 1882, and was admitted to the bar. He first began the practice of his profession in partnership with his father, under the firm name of V. O. Cassell & Son. Mr. Cassell possesses much ability as a lawyer and has won distinction as such in the city in which he resides. He has a large clientage, which increases each year, and he is well known in Norfolk County. In political belief, he is a Democrat, but takes no active interest in politics. Mr. Cassell lives with his family in Portsmouth. He attends the Protestant Episcopal Church.

Funeral services at the residence Thursday morning at 11 o'clock.

Mrs Pauline Cassell Johns
Mrs. Pauline Cassell Johns, widow of James M. Johns, died at 3:12 o'cock yesterday afternoon in the residence, 955 North street, at the age of 63 years. She was the daughter of the late Virginius O. and Mrs. Jane Cassell.
Mrs. Johns is survived by three sons, Virginius M. Johns of Howardsvill, Va., Charles W. Johns of Richmond and James R. Johns of this city. Three sisters also survive her. They are: Miss Ella J. Cassell and Mrs. Rosalie Martin of this city, and Mrs. Helen S. Webster, of Lexington, Va. Mrs. JOhns is also survived by four brothers, as follows: Charles M. Cassell, Norman Cassell and Heber C. Cassell, of this city. and Rev. Mortimer G. Cassell of Minter, Ala.
Mrs. Cassell was a member of Trinity P. E. Church.
The funeral service will take place at 11 o'clock tomorrow morning in the residence.

The funeral services of Mrs. Pauline Cassell Johns, who died last Tuesday, in the residence, 955 North street took place there at 11 o'clock yesterday morning. Rev. William A. Brown, rector of St. John's Episcopal church, officiated.
Burial took place in Oak Grove cemetery. The pall-bearers were as follows: William G. Maupin, Jr., John C. Niemeyer, John C. Emmerson, Henry P. Gilbert, John Nash Humes, and F. Nash Billisoly.
The service was largely attended, attesting the esteem in which Mrs. Johns was held. There was a profusion of floral tokens.
